These Terms and Conditions apply to your access to and use of the Drover Podcast website, podcast content, social media channels, newsletters, subscriber features, comments, paid memberships, and any related digital services we provide.

In these Terms, “Drover Podcast”, “Drover”, “we”, “us” or “our” means Drover Productions Pty Ltd ABN 96 650 661 420, based in Australia. “You” means any person who accesses, listens to, downloads, views, subscribes to, comments on, purchases from, or otherwise uses our content or services.

By using Drover Podcast, you agree to these Terms. If you do not agree, you must not use our website, content, products, memberships, or services.

1. About Drover Podcast

Drover Podcast produces and distributes podcast, audio, video, written, newsletter, social media, and related digital content.

Unless we expressly state otherwise, Drover Podcast content is provided for general information and entertainment purposes only. It is not professional, legal, financial, medical, psychological, investment, tax, business, or other specialist advice.

You should obtain independent professional advice before relying on any information discussed in our content.

2. Eligibility

You must be at least 16 years old to use our website and general content. If you are under 18, you must have permission from a parent or guardian.

Where we offer paid memberships, subscriptions, premium content, merchandise, events, downloads, or other paid services, you must have legal capacity to enter into a contract, or your parent or guardian must purchase or register on your behalf.

3. Changes to these Terms

4. Our Content

All Drover Podcast content, including podcast episodes, recordings, scripts, graphics, video, show notes, articles, logos, branding, newsletters, social media posts, subscriber content, downloadable resources, and other materials, is owned by or licensed to us and is protected by copyright, trade mark, and other intellectual property laws.

You may access and use our content for personal, non-commercial purposes only.

You must not, without our prior written permission:

1. copy, reproduce, republish, upload, post, transmit, distribute, sell, license, or commercially exploit our content;

2. edit, remix, adapt, translate, scrape, train AI models on, or create derivative works from our content;

3. use our name, logo, branding, voice, likeness, or content in a misleading, defamatory, unlawful, or commercial way;

4. remove copyright notices, sponsor disclosures, disclaimers, or attribution;

5. present our content as your own; or

6. use our content in a way that suggests we endorse you, your business, your product, your service, or your views without written approval.

You may share links to our publicly available content, provided you do so lawfully and do not misrepresent the source or context.

5. Guest Content and Opinions

Guests, contributors, advertisers, sponsors, and third parties may express opinions on Drover Podcast. Those views are their own and do not necessarily reflect our views.

We do not guarantee that guest statements are accurate, complete, current, or suitable for your circumstances. You are responsible for your own assessment of any information, claims, recommendations, or opinions discussed.

Guest participation, recordings, permissions, releases, and related rights are handled under a separate guest release or contributor agreement where applicable.

6. Subscriber Accounts and Comments

You may be able to subscribe, create an account, comment on content, submit questions, respond to posts, or otherwise interact with Drover Podcast.

You are responsible for any activity associated with your account, email address, username, or profile.

You must ensure any information you provide is accurate, current, and not misleading.

We may moderate, edit, hide, delete, refuse, or disable comments, accounts, or submissions at our discretion, including where we reasonably believe content is unlawful, defamatory, misleading, offensive, abusive, discriminatory, threatening, spam, infringing, harmful, or inconsistent with these Terms.

By posting comments or submitting content to Drover Podcast, you confirm that:

1. you own or have permission to submit that content;

2. the content does not infringe another person’s rights;

3. the content is not unlawful, defamatory, misleading, abusive, discriminatory, obscene, threatening, harassing, or otherwise inappropriate; and

4. you understand we may choose whether or not to publish, edit, respond to, remove, or use your submission.

Unless you tell us otherwise in writing, you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable licence to use, reproduce, edit, adapt, publish, display, communicate, promote, and distribute your submitted comments or content in connection with Drover Podcast and related promotional activities.

Do not submit confidential, sensitive, private, or third-party personal information in comments or public areas.

7. Acceptable Use

You must use Drover Podcast lawfully and respectfully.

You must not:

1. interfere with or disrupt our website, hosting, platforms, security, or systems;

2. attempt to gain unauthorised access to any part of our website, services, or accounts;

3. upload malware, spyware, bots, scripts, or harmful code;

4. scrape, harvest, crawl, or extract data from our website without permission;

5. impersonate another person or misrepresent your identity;

6. send spam, unsolicited promotions, or abusive messages;

7. submit comments or content that are defamatory, discriminatory, threatening, harassing, misleading, obscene, or unlawful;

8. breach the privacy, intellectual property, publicity, contractual, or other rights of any person; or

9. use our content or services for unlawful, harmful, fraudulent, or exploitative purposes.

We may block, restrict, remove, report, suspend, terminate, or take legal action in response to misuse.

8. Paid Memberships and Optional Paid Services

Drover Podcast may offer paid memberships, subscriptions, premium content, supporter options, subscriber-only features, merchandise, events, digital downloads, or other paid services from time to time.

Prices are displayed in Australian dollars unless stated otherwise. Prices may include or exclude GST depending on how they are presented at checkout.

You agree to provide accurate billing, delivery, and account information.

We may refuse, cancel, or limit an order, membership, subscription, or account where we reasonably suspect fraud, error, misuse, unauthorised resale, breach of these Terms, payment failure, or unlawful activity.

Any specific membership, subscription, product, ticketing, checkout, platform, or event terms displayed at the time of purchase or registration will also apply.

Unless stated otherwise, paid memberships are for personal use only and must not be shared, transferred, resold, sublicensed, or commercially exploited.

9. Renewals, Cancellations, and Access

Where paid memberships or subscriptions are offered, they may renew automatically unless cancelled before the renewal date.

You are responsible for managing your subscription through the relevant platform, payment provider, app store, or account settings.

If you cancel a paid membership, you may continue to have access until the end of the then-current billing period, unless otherwise stated.

We may suspend or terminate access where payment fails, chargebacks occur, misuse is detected, or these Terms are breached.

We do not guarantee that any specific subscriber content, membership benefit, feature, episode, platform, or community function will remain available indefinitely.

10. Refunds and Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or other laws that cannot be excluded.

Where Australian Consumer Law applies, our goods and services may come with guarantees that cannot be excluded. You may be entitled to remedies if a product or service fails to meet those guarantees.

Subject to your non-excludable rights:

1. digital products may not be refundable once accessed, downloaded, streamed, or delivered;

2. paid membership fees may not be refundable for change of mind;

3. event tickets may be subject to specific refund or transfer conditions;

4. merchandise returns may require proof of purchase and must comply with any return instructions we provide; and

5. we are not required to provide refunds where you change your mind, misuse a product, fail to use a service, forget to cancel a subscription, or lose access due to breach of these Terms.

11. Sponsorships, Advertising, Affiliate Links, and Commercial Relationships

Drover Podcast may include paid sponsorships, advertisements, affiliate links, gifted products, brand collaborations, referral arrangements, or other commercial relationships.

We aim to disclose commercial relationships where required or appropriate. However, you are responsible for assessing whether any product, service, promotion, or recommendation is suitable for you.

Where we use affiliate links or referral codes, we may receive a commission, fee, benefit, discount, or other value if you click a link or make a purchase.

Third-party products and services are provided by the relevant third party, not by Drover Podcast. We are not responsible for their quality, availability, claims, delivery, support, terms, privacy practices, or performance.

12. Third-Party Platforms and Links

Drover Podcast may be available through third-party platforms, including podcast apps, streaming services, social media platforms, newsletter providers, video platforms, comment tools, payment processors, analytics providers, advertisers, or embedded content providers.

Your use of those platforms is governed by their own terms and policies.

We do not control third-party websites, apps, platforms, algorithms, availability, moderation, data handling, or content. We are not responsible for any loss, damage, claim, or issue arising from your use of third-party services.

13. No Warranties

To the maximum extent permitted by law, Drover Podcast and its content are provided on an “as is” and “as available”basis.

We do not guarantee that:

1. our content will be accurate, complete, current, uninterrupted, secure, or error-free;

2. our website, comments, memberships, or platforms will always be available;

3. defects will be corrected;

4. our content will meet your expectations or requirements;

5. third-party platforms will continue to host or distribute our content; or

6. any particular outcome will result from using or relying on our content.

14. Limitation of Liability

To the maximum extent permitted by law, Drover Podcast, Drover Productions Pty Ltd, its directors, officers, employees, contractors, hosts, producers, editors, guests, contributors, sponsors, and related parties are not liable for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including loss of profit, revenue, opportunity, data, goodwill, reputation, or business interruption.

To the maximum extent permitted by law, our total liability to you for any claim relating to Drover Podcast is limited to the greater of:

1. the amount you paid us for the relevant product or service giving rise to the claim; or

2. AUD $100.

Nothing in these Terms limits liability that cannot legally be limited, including liability under applicable consumer protection laws.

15. Indemnity

You agree to indemnify Drover Podcast, Drover Productions Pty Ltd, and its related parties against any loss, damage, liability, cost, expense, claim, or demand arising from:

1. your breach of these Terms;

2. your misuse of our content, website, products, memberships, comments, or services;

3. your submitted comments or content;

4. your infringement of another person’s rights;

5. your unlawful, misleading, fraudulent, or harmful conduct; or

6. your breach of any applicable law.

16. Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.

By using Drover Podcast, subscribing, commenting, or interacting with us, you acknowledge that we may collect, use, store, and disclose personal information as described in our Privacy Policy.

17. Competitions and Giveaways

If we run competitions, giveaways, promotions, or listener offers, additional terms may apply.

Unless stated otherwise, promotions are not sponsored, endorsed, administered by, or associated with any third-party social media or podcast platform.

We may cancel, modify, suspend, or disqualify entries where we reasonably suspect tampering, fraud, technical issues, breach of rules, or unlawful conduct.

18. Termination or Suspension

We may suspend, restrict, or terminate your access to Drover Podcast, including memberships, subscriber features, comments, or community functions, if we reasonably believe you have breached these Terms, misused our services, caused harm, or created legal, security, operational, or reputational risk.

Sections intended to survive termination will continue, including intellectual property, disclaimers, limitation of liability, indemnity, privacy, and governing law.

19. Force Majeure

We are not liable for delay or failure to perform where caused by events beyond our reasonable control, including platform outages, internet failures, cyber incidents, natural disasters, pandemics, strikes, regulatory action, supply chain issues, payment provider failures, or acts of government.

20. Governing Law

These Terms are governed by the laws of New South Wales, Australia, unless another Australian state or territory is specified by Drover Productions Pty Ltd.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts of Australia.
